The National Industrial Court of Nigeria (NICN) is urged to declare that the process of selecting the Account General (of the Federation) begun by the Federation’s Head of Office is null and void.
Mr. Joshua Kadmi Luka, who made the prayer in a writ of summons endorsed by Ibrahim Angula, SAN, is also asking the court to allow him to participate in the selection process of the Accountant General of the Federation.
Prince Lateef Olasumkanmi Fagbemi (Attorney General of the Federation) and Miss Didi Esther Walson Jackson (Head of Service of the Federation) are sued as respondents.
According to the writ of summons obtained by journalists, Mr Joshua’s exclusion from participating in the selection process for Accountant General of the Federation on an allegation without a hearing was an infringement of his rights to a fair hearing and, therefore, null and void.
Mr Joshua posed six questions during the trial for determination. The law requires the respondents to attend the court within 14 days.
Mr. Joshua’s other questions include whether or not it is the duty of the Federal Civil Service Commission to appoint the AG of the Federation and whether or not she is empowered by law to supervise, order, and/or commence the process for the section of Permanent Secretaries/Account General of the Federation, in clear violation of the Constitution of Nigeria.
